Terms and conditions

The Parfums Lolita Lempicka website (hereinafter the "Site") is an e-commerce Site of PACIFIC CREATION accessible via the Internet at www.parfumslolitalempicka.com, which sells Parfums Lolita Lempicka Products.

The Site allows the PACIFIC CREATION Company, a simple stock company with capital of EUR 40,800,000, whose registered office is located at 6-8, Rue Caroline, 75017 Paris, France, registered with the Registry of Commerce and Companies of Paris under the number 410238 364, for its brand Parfums Lolita Lempicka, to offer Lolita Lempicka perfumes and cosmetics (hereinafter the "Products") for sale to Internet Users on the Site (hereinafter referred to as "Users").
The Crédit Agricole bank, based in France, is in charge of online payment.
For the purposes hereof, it is agreed that the User and PACIFIC CREATION will be jointly referred to as the "Parties" and individually called "Party" and that the User who has submitted an order will be referred to as "Purchaser". The rights and obligations of the User necessarily apply to the Purchaser.

It is stated that the Products are solely intended for the User’s personal use and not any kind of professional use.

Products ordered by the User will be delivered exclusively in Metropolitan France by Chronopost, and in mainland France (Corsica and Monaco included) by Colissimo, or in Belgium and Spain by UPS Standard.

The User who wishes to purchase on the Site states he has full legal capacity.

To order a Product offered on the Site, the User is required to read and expressly accept these General Terms and Conditions for Sale, without conditioning this acceptance by a handwritten signature. In accordance with Articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree No. 2001-272 of March 30, 2001, enacted for the application of Article 1316-4 of the French Civil Code, relating to electronic signatures, it shall be noted that the validation of the order as specified in Article 5: 'Methods of Ordering', is an electronic signature which has, between the Parties, the same value as a handwritten signature.

It is stated that the User may save or print these General Terms and Conditions for Sale, provided, however, he does not change them.

The purpose of these General Terms and Conditions for Sale is to define the Parties' rights and obligations arising from the online sale of Products offered on the Site from France, exclusively because of the relationships they establish on the Internet and only on the Site. They determine all the steps necessary to place an order as described in Article 5: 'Methods of Ordering' and ensure follow-up of this order between the parties.

PACIFIC CREATION reserves the right to update these General Terms and Conditions for Sale at any time.

These conditions apply to any sale on the Site to the exclusion of any other document, including the conditions applicable to sales of perfumery or through other distribution channels and marketing.

2.1. Description of Products: The Products offered for sale by PACIFIC CREATION are those listed on the Site on the day of consultation of the Site by the User, within the limits of available stocks and subject to the conditions stipulated in the preamble hereinabove. PACIFIC CREATION reserves the right to withdraw Products from sale at any time.

PACIFIC CREATION takes great care to present the Products on the Site in accordance with the requirements of Article L.111-1 of the French Consumer Code. However, photographs illustrating the Products are only indicative and are not contractual. PACIFIC CREATION shall not be held liable should they be incorrect in any way.

While every effort is made to ensure that the shades of the Lolita Lempicka Products whose photos are posted on the Site www.parfumslolitalempicka.com are faithful to the original Products, variations may occur, especially due to technical limitations of the color renderings of computer equipment. Therefore, PACIFIC CREATION cannot be held liable for the errors or inaccuracies of photographs or graphic representations of Lolita Lempicka Products presented on the Site www.parfumslolitalempicka.com.

2.1. Availability of Products: Products are offered within the limits of available stocks. PACIFIC CREATION does not guarantee the availability of the Products presented on the Site. The Purchaser shall be informed as early as possible of any Product availability. The Purchaser shall be notified of this information by e-mail prior to delivery and following the validation of the order.
If payment was made by debit card, PACIFIC CREATION will then arrange with the banking group Credit Agricole to subtract the sales price(s) of the unavailable Product(s) from the amount withdrawn from the Purchaser’s bank account.

In cases where the unavailability of a Product is noted after the order is validated, the Purchaser will have the opportunity to cancel the order by either requesting a refund of amounts paid within thirty (30) days at the latest after their deduction, or the exchange of unavailable Product(s), by e-mail sent to service.client@fr.amorepacific.com.

PACIFIC CREATION incurs no liability for out of stock or unavailable Products.

2.3. Retention of Ownership: The Products ordered remain the property of PACIFIC CREATION until full payment of their sales price. In the event of a payment incident, you agree to return the Products received to PACIFIC CREATION upon first request.

However, on the actual date of delivery, the risks (including loss, theft or damage) concerning the Products delivered are assumed by Purchaser.

The prices of Products and services are firm and given in Euros. They are fixed by the rates in effect on the day of the order. The current rate is that indicated on the Site, unless there is a typographical error. All orders are billed at the price including tax, with the French VAT applicable on the date of the order. Any change to the VAT rate will be reflected in the price of the Products presented on the Site, on the date stipulated by the decree of application relating thereto.

PACIFIC CREATION reserves the right to freely change the prices of Products at any time and without notice, without other formality than making changes to the Site. However, these changes will not affect orders that PACIFIC CREATION has accepted before the entry into force of these changes and the Products will be charged on the basis of the rates in effect when the order was placed, on condition of the availability of the Products ordered.

The prices shown do not include packing and delivery costs, which will be charged extra and will be specified to the User during the final confirmation of the order when the total price will be shown on the order summary.

The price is that shown on the order confirmation sent by e-mail to the Purchaser by Parfums Lolita Lempicka.

Unless the server is unavailable, the orders are paid in Euros on the Site immediately upon registration of the order by card (Debit Card, MasterCard, Visa), excluding any other method of payment. The Purchaser will enter the card number, expiration date thereof, the cardholder and the visual cryptogram (the last 3 numbers on the back of the card). Secure payment by Visa and MasterCard is assured by 3D Secure technology.

PACIFIC CREATION reserves the right to refuse any order or delivery in case of exceeding the limits outlined in the preamble hereof; dispute with the Purchaser; total or partial nonpayment of a previous order by the customer; refusal of authorization of card payment by the banking organization; non-payment or partial payment.

The Purchaser guarantees PACIFIC CREATION that he has the required authorization that may be necessary to use the chosen method of payment at the time of checkout. In case of refusal by the bank, the order is automatically canceled and the customer is alerted by e-mail.

As part of the fight against fraud on the Internet, PACIFIC CREATION uses a secure e-payment transactions tool that is provided by the Credit Agricole bank and guarantees the customer that it has never had access to confidential information relating to the method of payment used by the Purchaser to pay for his order. Only PACIFIC CREATION’s bank remains in possession of such information.

This is why the consumer’s bank details will be required for each subsequent order they wish to place on the Site.

PACIFIC CREATION invites the customer to print the summary of the order. Data regarding orders will be recorded and stored in computer systems of OVH, which is based in Paris, the host of the Website www.parfumslolitalempicka.com on behalf of PACIFIC CREATION and the banking partner of PACIFIC CREATION, Crédit Agricole. The information records for these companies are considered proof of all transactions between the Parties on the Site. The storage and processing of the data concerning the orders is carried out on a reliable and durable medium that can be produced as evidence.

5.1. Navigation within the Site: The User can access the various Products offered for sale by PACIFIC CREATION on the www.parfumslolitalempicka.com Site. The User can freely browse the pages of the Site, without being committed to an order.

5.2. Submitting an Order: If the User wishes to place an order, he chooses the Products that are of interest to him, and demonstrates such interest by clicking the "Add to basket" button.

Each new addition to his basket will be indicated by the appearance of the number of articles in the basket at the top right of the page.
At any time, the User may:
- Obtain a summary of the Products he has selected or modify his order by clicking on the “My Basket” basket accessible at the top right of each page
- Continue his selection of Products by clicking "Continue Shopping"
- Complete selection of Products and order them by clicking on "Continue" .

To order the Products he has chosen, the User clicks on the icon "My Basket". A summary of the order appears on the screen. If the list presented to him corresponds to the Products he has chosen, the User validates the summary checking the box opposite the message "I accept the General Terms and Conditions for Sale" for approval before clicking on "continue".

Then, the User can choose 3 samples for free among a selection, checking the box opposite the selected samples and clicking on "Continue". If the User does not want to receive any samples, he can click straight on "Continue".

The User must then identify himself:
- Either by entering his email address and password, if he is already a registered User.
- Or by accurately completing the form made available, on which he will enter the information necessary to identify him and include his full name and mailing address.
The User is informed and agrees that entering any identifier is considered valid proof of identity and expresses his consent.

Once identified, an order form will appear on the screen, summarizing the nature, quantity and prices of Products selected by the User, and the total amount of the order, the User’s details, and the address for delivery of the Products.

5.3. Final Submission of an Order: The User must select the payment method offered on the same page.

If the User pays for the order by card, he validates this page by clicking on “Debit Card”, “VISA” or “MASTERCARD”. The User is then prompted to enter his bank details. Orders paid by debit card are submitted after entering the bank information on the payment partner’s secure pages designated by PACIFIC CREATION: E-transactions by Credit Agricole.

5.4. Confirmation of Order: When the Purchaser submits his order and payment, a summary is displayed and includes the transaction number. This summary is sent to him in an order confirmation e-mail by PACIFIC CREATION. This confirmation includes all the elements of the contract between the Parties.

Then, when the order is prepared and shipped, an e-mail shipping confirmation is also sent to the Purchaser.

Data recorded by the Site will constitute proof of all transactions between PACIFIC CREATION and the Purchaser. In case of a conflict between PACIFIC CREATION and the Purchaser concerning a transaction on the Site, the data recorded by PACIFIC CREATION are considered to be irrefutable evidence of the contents of the transaction.

Pursuant to Article L. 134-2 of the French Consumer Code, when an order is placed for an amount equal to or greater than 120 Euros, PACIFIC CREATION keeps the written proof the contract between PACIFIC CREATION and the Purchaser electronically for a period that runs from the entering of the contract until the date of delivery of the goods and for a period of ten years from then (in accordance with the Decree 2005-137 of February 16, 2005). The Purchaser then has access to this document at any time, upon request made to serviceclient@parfumslolitalempicka.com, by attaching proof of his identity.

6.1. Terms of Delivery

Orders are prepared the same day (working days) if submitted before 12:00 noon, or on the next working day.

Sundays and public holidays do not count as working days.

Once the orders are prepared, they shall be delivered to the address of your choice by La Poste through the services Colissimo Expert in Continental France (including Corsica and Monaco) and Chronopost exclusively in Metropolitan France upon signature by the Purchaser, or by TNT in Europe.

Products ordered by the Customer will be delivered to the address indicated by the latter on the order form or deposited at La Poste for the delivery address stated by the customer, in the absence of the recipient of the Products. In the latter case, the postman will leave a calling card in the recipient’s mailbox to collect the package during regular business hours at the La Poste, within fifteen (15) days.

The Customer can follow the progress of his delivery on the Site (in French) by clicking on the "My Account" icon and indicating the email address and password information entered when ordering.

Upon receipt of the Products, the Purchaser shall check the conformity of these Products. Any anomaly concerning the delivery (Product missing or broken, damaged package, etc.) should be reported by the Purchaser on the delivery slip that is submitted to him by La Poste when the package is handed over and must always be notified to the PACIFIC CREATION Customer Service, by e-mail sent to serviceclients@parfumslolitalempicka.com or by phone to +33 (0)1 44 70 40 93 between 10am and 5pm Monday through Friday (cost of a local call if phoning from France). Any claims made after 7 days shall be rejected and PACIFIC CREATION shall be released of any liability.

PACIFIC CREATION shall not be liable for any loss, mailing to a wrong address, or delay in delivery of a Product, to the extent that the risks of the method of transportation that the Purchaser chooses are incumbent on him.


6.2. Delivery Periods

La Poste undertakes to deliver within 48 hours via the Expert Colissimo service and within 18 hours by Chronopost.
TNT tells an average delivery within 48 hours via the TNT service to Europe.

In any event, the order will be carried out no later than within thirty (30) days from the day following the submission by the User of his order.

Should goods not be delivered within this period, the customer may cancel his order. The amounts paid by the customer will be refunded, excluding any other compensation.

Since delivery is guaranteed by a third party, PACIFIC CREATION does not assume any liability for delivery times that are too long due to the postal services, and in case of loss of the Products ordered or a strike by the postal services. It is specified that the risks of transportation shall be borne by the Purchaser.

In case of late delivery, the Purchaser shall report this delay, as soon as possible to PACIFIC CREATION customer service, by e-mail sent to serviceclients@parfumslolitelempicka.com or by phone to +33 (0)1 44 70 40 93 from 10am to 5pm Monday through Friday (cost of local call if phoning from France).

PACIFIC CREATION shall then contact the postal services in order that an investigation can be conducted. A postal survey may take some time. Furthermore, it is specified that the ownership of the Products will not be transferred to the Purchaser until total payment of the price charged, included in shipping costs.

6.3. Delivery Prices

The mailing costs famount to :
€5.70 for Colissimo Expert;
€9.50 for Chronopost;
€10.90 for UPS Standard.

Packages must be returned by La Poste by sending by standard mail service to the following address:

7.1. Product(s) unsatisfactory to the Purchaser: The Purchaser shall have seven (7) working days to return the Product(s) he ordered, at his expense, if it (these) does (do) not give him satisfaction. This period starts on the day of order delivery. The Product(s) must be returned in its (their) packing and its (their) original packaging, and accompanied by the return slip attached to the invoice, to the following address:

PACIFIC CREATION does not accept packages with postage due.
Any risk connected to the return of Product(s) is borne by the consumer.

If the above-mentioned conditions are fulfilled, PACIFIC CREATION shall reimburse the Purchaser, within thirty (30) days, for the amounts corresponding to the Products acquired by him.

7.2. Non-Compliant Product(s): Any non-compliant Product to be exchanged or refunded must be returned within seven (7) working days to CROSSLOG in its original packing and packaging, accompanied by the return slip. It is specified that shipping costs will be reimbursed by PACIFIC CREATION in cases where the decision to return is the result of an error by PACIFIC CREATION.

It is specified that the shipping costs shall be borne by PACIFIC CREATION where the decision to return is the result of an error by PACIFIC CREATION.

PACIFIC CREATION will then exchange or refund the Product(s) damaged or missing.

Upon receipt of the Product(s) alleged to be non-compliant, PACIFIC CREATION shall carry out as soon as possible a review of the Product(s). If the non-compliance of the Product(s) is confirmed by PACIFIC CREATION, the Purchaser will be reimbursed within thirty (30) days for the amounts corresponding to the price(s) of the Product(s) acquired by him.

Personal information collected as part of long distance selling is required, since this information is needed for processing and delivery of orders and for the preparation of invoices. This information is strictly confidential. Lack of information involves the automatic rejection of the order.

In accordance with French Law No. 78-17 of January 6, 1978 relating to data, files and freedom, the processing of personal data collected on the Site has been registered with the Commission Nationale de l’Informatique et des Libertés [French Data Protection Authority]. The User has the right to access, modify, rectify and delete data concerning him. To exercise this right, the User must send a letter to customer service:

The User may receive e-mails from PACIFIC CREATION informing him of the Products and activities of PACIFIC CREATION’s Products and activities. The User retains the right to refuse a posteriori such e-mails either by declining at the time of the order, or by expressing his refusal by e-mail to serviceclients@parfumslolitalempicka.com or by mail to the following address:

.The Site uses cookies. A cookie is an information file stored on the hard drive of the User’s computer. Its purpose is to report an earlier visit by the User to the Site. The cookies are solely used by PACIFIC CREATION to personalize the services offered to the User.

.No Party shall be responsible for non-performance in whole or in part of its obligations under this contract, if such non-performance is caused by an event constituting an event of force majeure.

Any events that meet the criteria established by the jurisprudence of the 2nd Civil Chamber of the Supreme Court of Appeal will be considered to be an event of force majeure.

The Party claiming an event constituting force majeure shall notify the other Party within five working days of the occurrence or threat of this event.

The Parties agree that they shall consult as soon as possible to jointly determine the methods for processing the order during the period of the event of force majeure.

Beyond a period of one (1) month of suspension due to force majeure, PACIFIC CREATION may not honor the order, and may be required to reimburse the Purchaser.

The intellectual property rights attached to the Products sold on the Site are and shall remain the exclusive property of PACIFIC CREATION and are subject to an exclusive license in favor of PACIFIC CREATION. PACIFIC CREATION exclusively holds all rights of use.

.These General Terms and Conditions for Sale and the order summary sent to the Purchaser form an entire contract, and constitute the entire contractual relationship entered into between the Parties.

In the event of a contradiction between these documents, the General Terms and Conditions for Sale shall prevail.

Under these conditions, no one is authorized to reproduce, use, disseminate or use the intellectual property rights in any capacity whatsoever, even partially, without the prior written consent of PACIFIC CREATION. The Parfums Lolita Lempicka trademarks and logos are registered trademarks. Any reproduction is therefore an infringement.

PACIFIC CREATION is only bound by an obligation of means. The Purchaser is the sole judge of how suitable and appropriate the articles he orders are to his needs and use.

PACIFIC CREATION cannot be held liable for any use of the Products that is not in compliance with their intended purpose.

PACIFIC CREATION cannot be considered liable (i) for the loss, alteration or fraudulent access to the User’s personal data, (ii) for the accidental transmission of viruses or other harmful elements resulting from access to the Internet or by e-mail transmissions.

PACIFIC CREATION does not warrant that the Site shall be available on a permanent basis, without temporary interruption, without suspension or without error.

Without limiting the scope of the other provisions of the General Terms and Conditions for Sale, PACIFIC CREATION’s liability can only be held against it in case of proven fault solely attributable to it. In any event, it will be solely limited to direct damages.

PACIFIC CREATION reserves the right to suspend the operation of the Site.

These General Terms and Conditions for Sale and the contractual relationship between PACIFIC CREATION and the Purchaser are subject to French law.

Any dispute arising from the application or interpretation of the General Terms and Conditions for Sale is under the exclusive jurisdiction of the courts of Paris, the permanent location of PACIFIC CREATION.
